Terms & Conditions of Business:
Domain' is the website address as specified by the Client.
Hosting' is a yearly cost to keep a clients website activated online
Content' is both text and images that the Client requires on the website.
Mb stands for megabytes and is a measure of storage space.
Fash Media Ltd will only commence work on a Project after receipt of a non refundable, 50% deposit of the quoted Project fee from the Client. Fash Media UK Ltd will also require 25% payment on approval of the overall design concept. The final 25% payment is to be made on completion of the website. The website will be switched to Live Mode once the Clients remaining balance is paid in full.
A domain name will be registered by Fash Media on behalf of the client once we have received the 50% deposit, 25% design payment, 25% final payment and a completed creative brief. Automatic emails (2 emails) will be sent to clients prior to the expiring date of hosting and domain. The system will automatically shut down the site & there is a sum of £25 fee to restore the website back up again
As a gesture of good will we will submit site map of website to search engine - Although, we can not guarantee that the site will be indexed or ranked in search engine e.g Google.
Fash Media shall expect the Client to carry out sufficient research before proceeding with a website. This will include checking that the website/idea/business will operate legally. It is important that the website is not in any way illegal.
It is important for the Client to keep in contact with Fash Media Ltd throughout the entire Project. If a Client does not make contact for 1 week we will make up to 5 attempts to contact the client by email using the email address specified when the client went ahead. If we do not receive a response to these attempts of contact the Project may be terminated, and the deposit will not be refunded. Alternatively,
If the website completion is being delayed by the client and at least 75% of the design work has been completed, the client may be asked to pay the final 50% payment.
As part of the promotion customers are entitle to 1 year free domain and hosting.
Payment/Receipt of the balance is due immediately on completion of the website. We reserve the right not to launch a website until full payment has been received.
Any websites previously launched may be removed if payment is not forthcoming. When this occurs an additional minimum charge of £50 will be required to have the site restored.
The price quoted to the client is for the work specifically agreed on the quotation only. Should the client decide that changes are required after work on the website has commenced there may be a surcharge.
Unless otherwise agreed, payment is only accepted by credit card, cheque or bankers draft in UK Pounds Sterling. If your cheque is returned by the bank as unpaid for any reason, you will be liable for a "returned cheque" charge of £35.
A £35 Consultation fee will be required if a client withdraws after given us a go ahead, or stops a cheque and or tthe service after a member of staff had been to the customer for a presentation or an appointment.
Accounts that have not been settled within 5 days of our final reminder will incur a late payment charge of 15% of the amount outstanding. You will also be charged statutory interest of 8% above the reference rate (fixed for the six month period within which date the invoices became overdue) pursuant to the late payment legislation.
Problems caused by malicious software, spyware, viruses and website hacking are a fact of life on today's Internet. It is highly unlikely that these will affect your website, and Fash Media will endeavour to protect it from this as much as we can during its creation, but after the website is handed over we cannot be held responsible for problems caused by illegal activity or the actions of others.
We reserve the right to charge extra for excessive use of bandwidth. We will contact the customer prior to implementing any extra charges. We also reserve the right to remove offensive materials from the server or files that are causing excessive downloads.
We provide a basic support system to help with getting started with your email accounts and using the control panel. This service may be charged for if it becomes time consuming at our discretion. We are happy to help with advice but we do not provide an IT support service as such.
We may require ongoing access to our clients' hosting space to allow us to support and monitor their websites. This access is via a user ID and password combination, which the client may change after the website is handed over. If the client chooses to change the password we will no longer have access to the website and further support will not be possible. We cannot be held responsible for any changes made to the website by the client or the client's agents.
We design websites in accordance with the client's specifications. It is the client's responsibility to ensure that the website and its content comply with current online trading laws and regulations.
The quotation provided will be valid for 30 days from the date of receipt.
Fash Media keeps records of it's clients for business purposes only, such as invoicing and contacting regarding new services. We do not pass information on to any third party.
Fash Media reserves the right to change or modify any of these terms or conditions at any time. Should clarification of any of the above be required please contact us.
